I am a hobby artist and streamer. I have been drawing since Kindergarden but I've been taking it more seriously lately!
I am currently finishing Highschool & going to University next year to become a Financial Administrator. I unfortunately have chronic pain, of which I do not know the cause yet, along with almost daily headaches. So i apologize if there's any delay in my work.

You will agree to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.

1.1 || You, the client, may display my work on external sites as long as it is visibly credited and linked back to me.- You may not claim my work as your own.

1.3 || You are NOT authorized to change, modify or edit my art - Ask me and I will more often than not change it for you!
1.4 || You are NOT authorized to trace over my artwork in any way, including the use of the artwork as a base.
1.5 || Clients who have commissioned and/or recieved work before this TOS has gone into effect are still bound to its contents.

1.7 || By commissioning me, you are purchasing my service as an artist only.
1.8 || I reserve the right to post your finished artwork in my gallery - unless NDA fee is payed.

1.10 || I reserve the right to refund you - partially, based on progress - if I no longer wish to work on your project for any reason.

✦ Personal Usage
2.1 || You may use the artwork & designs for personal use including but not limited to: avatars, phone or computer wallpapers, personal website/profile display.
2.2 || You reserve the right to print or create an otherwise physical reproduction of the artwork as long as it is for your PERSONAL use only (ie. not for SALE).
✦ Monetized Usage
2.3 || Monetization rights are not included in the "personal license" purchase option.
2.4 || You may purchase monetization rights during or after purchasing the art or design, you may NOT use a design for monetization until payment is sent.
2.6 || Monetization rights include Streaming/Vtubing/Content creation use.
2.7 || Content Creation use includes the following: PNGtubers, Vtubers, Stream Pets, Emotes, Alerts, Vtubing Accessories, Panels.
2.8 || Monetized Usage starts at 25% for both artwork and design.
✦ Commercial Usage
2.9 || Commercial rights are not included in the "personal license" or the "monetized license" purchase option.
2.10 || You may purchase commercial rights during or after purchasing the art or design, you may NOT use a design commercially until payment is sent
2.11 || Commercial rights include Merchandising, selling of purchased artwork.

✦ General
3.1 || Your are subject to the rules regardless of whom you got my design from, as long as you you currently have one in your possession.
3.2 || Do not upsell designs of mine that you have traded or purchased.
3.3 || Do not SELL designs of mine that you have obtained for free UNLESS they have additional artwork - You may still Tade/Gift/Swap these designs.
3.4 || You may NOT claim my designs as your own. Please credit properly [kortaxx_ via all socials; kortaxx.bsky.social]
3.5 || You are NOT authorized to change, modify, edit my art - Ask me and I will more often than not change it for you!
3.6 || You are NOT permitted to colorpick the majority of or the entirety of a design // Nor make a carbon copy/rip-off of my designs. That will result in a Greylist or Blacklist based on severity. ASK to take inspo!!
3.7 || You can change the species of/overhaul any of my designs you own without permission! You must continue to credit me as the original creator.
3.8 || You may Co-Own my designs. But you may not come to me if there is any issue between you and the co-owner(s). It is not my responsibility.
3.9 || I ask you to not void my designs, if for some reason they don't sell or you don't want them anymore - You are welcome to shoot them back to me.
3.10 || You may NOT use my designs as a means to promote xenophobia, racism, disturbing fetish art, or anything regarding proshipping/pedophilia/shota/loli. I have the right to blacklist you if what you use my designs for anything that makes me uncomfortable and promotes harm.
3.11 || I ask you to NOT make "Twin" designs off alterative hair color/styles or body patterns/colors. It can cause problems with trading/selling/swapping said design in the future.
✦ Offers || Bids || Payment Plans
4.1 || I hold the right to back out of or decline an offer for any reason - without explanation.
4.2 ||You, the client, may back out of the offer for any reason. However, doing so to a very frequent amount can result in a Greylist or Ban from offers.
4.3 || If you constantly back out of or rescind your bid on Bid adoptables, you will be banned from future bids.
4.4 || Please have what you ready to be paid within 24hrs, unless the bid specifically states that it allows payment plans.
4.5 || All payments must be in EUR, through Kofi or Vgen. Within 24hrs of an offer being accepted unless otherwise discussed.
4.6 || I do not typically take holds from customers I have not worked with before.
4.7 || Any payment plans will require 25% put down, upfront. This goes for Autobuys, Bids and Offers alike, this downpayment & future payments are NONREFUNDABLE.

✦ Ordering
5.1 || I reserve the right to make changes to your request as I see fit unless otherwise discussed. To guarantee the total accuracy of your commission request, please make note of the required details and elements in the form.
5.2 || If your character is extremely detailed, I have the right to charge a fee to include these details. This fee will be stated before the transaction, and you hold the right to make changes to your commission request [e.g. change the character, agree to simplified design changes] before the transaction is complete.
5.3 || Before taking part in any transaction you are required to wait for a reply so that we can discuss the details.
✦ Payment
6.1 || I am not responsible for any mistakes that are made on your part over the course of the transaction.
6.2 || It is expected that you, the client, deposit 100% of the price upfront before I start. Payment plans are allowed if discussed beforehand. Beyond that there is no exception.
6.3 || If payment is not made in a timely manner after I've given the information, the commission will be cancelled. - Repeated counts of commissioning and failing to pay will result in blacklisting
6.4 || Once I start the sketch there will be NO REFUNDS.
6.5 || If I cancel a project, I will reimburse the lost fees and refund based on the progress of the project.
✦ Queue || Scheduling || Work Speed || Deadlines
7.1 || I usually take up to 1-3 business days to respond to your initial order inquiry.
7.2 || You reserve the right to set a deadline for your commission. This deadline must be disclosed before prior payment.
7.3 || I have the right to decline a project if there is too short of a time allowance. I reserve the right to take up to 2 weeks to begin work on your project - You will be notified once I start.
7.4 || If you did not alert me to a deadline, you must not send reminders until the agreed upon deadline has passed and I have not given information as to why the project isn't finished. Reminders will be ignored if they relate to work that I have prioritized above your project, including other commissions and gift art.
7.5 || If due dates are discussed, it is also the clients' responsibility to ensure prompt communication. I will not be held responsible for late delivery.
7.6 || No harassment over my work speed will be tolerated, regardless of the time that has passed.
7.7 || I will work on commissions randomly. This means I will work on the piece that has the closest due date or the piece I'm most inspired to work on.
7.8 || You reserve the right to be notified of any delay.
✦ Revisions || Feedback
8.1 || I will send a WIP ("work in progress") image after 100% of the payment is completed.- This excludes payment plans.
8.2 || These images will come in the form of .png files as an attachement via the chosen communication platform.
8.3 || You, the client, are responsible to ensure that your order contains the details you want me to follow.
8.4 || I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.
8.5 ||I will only send a guaranteed WIP for the Pose, Sketch and close to finished piece, but you are free to request a WIP at any given time.
8.6 || Major revisions are only allowed during the Pose and Sketch phase of the project. Only minor adjustments within reason can be made afterwards.- Any major revisions during the finishing stage may result in an additional fee.
8.7 || Each time I send a WIP to a client, I ask the client to provide feedback to me.
8.8 || Any changes to the character or subject will be subject to a fee, and the fee will depend on the progress of the work and the nature of the change.
8.9 || I will not be held responsible for any changes in ownership of the said character.
8.10 || After the order is complete, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my fault (e.g. I overlook details provided in the order)
8.11 || In the absence of feedback from the client, any changes to the final piece will be subject to a fee. You, the client, need to ensure feedback within 5 days of sending a WIP - if no feedback is send I will continue working on the project.
8.12 || I will not redraw a completed commission unless payment is received for a second order.
✦ Final Product
9.1 || There may be slight differences between the samples in my gallery and the illustration you will receive.
9.2 || I reserve the right to reject critiques pertaining to artistic skill and stylization, and if the critique reduces the artist quality of the piece.

9.4 || You, the Client, are responsible for saving any information, images, and other digital data I provide.
9.5 || Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to a year. However, I cannot guarantee against computer/device failure or accidental deletion or loss.
9.6 || I am not required to post your project in any public space, and if posted, I am not required to keep it there indefininetly. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use.
